Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.http://repositorio.unialfa.com.br/handle/123456789/518This master's dissertation covers connections between the process law (administrative and civil) with the notary and registry law, which also concerns the analysis the objectives adverse possession which concerns the expansion of access to justice permitted for the simplification of the certification of property ownership. For this reason, the dissertation offers analysis for aspects of the history and nature of the institute of adverse possession and its application over a long period of time and in light of failings in the legal system to recognize formal ownership, particularly in the Brazilian land context in which private lands were ceded by the first time in 1850. In this sequence, other aspects of the extrajudicial documents are analyzed, including historical, legal and constitutional support to ensure that elements are evident that allow a faster response in the management of private interests, including the request for an acquisition order. Furthermore, the analysis of the phenomenon of dejudicialization implies the opening of alternative forms of conflict resolution and the possibility of not returning to extrajudicial services. These solutions are more common with the practical and theoretical difficulty of the judiciary in conducting a tortuous process in a timely manner. It infers, insofar as the need to go through the formality of owners who are informed for the purpose of proposing ensures that only one difficult situation - possession - which must be clearly stated and recognized to obtain liability against all, is a feature of the real right to property, beginning as far as possible under the control of the State. In this context, adverse possession, which was carried out under the strictly jurisdictional rules of the CPC/2015, is now considered an extrajudicial modality, which involves a lawyer's petition, a certificate for the purpose of justifying possession of the table and an administrative process with material qualification led by the registrar. It is important to highlight that notaries and registrars are institutions that enjoy reputation and work efficiently through their delegates, which is the technical and legal knowledge of Notarial and Registration Law, thus making them the most suitable to qualify and decide on issues involving real estate regularization. The methods, peculiarities and limitations regarding the legal form of property acquisition are analized.ptDireito NotarialUsucapião ExtrajudicialDesjudicialização da Justiça.Direito RegistralUsucapião extrajudicial: a simplificação do procedimento e a facilitação do acesso à justiça
