Thus, based on specialized doctrine and highlighting the jurisprudential understanding, mainly of the Superior Court of Justice, the work is dedicated to the study of fraud in execution, from its beginning, absence of objective good faith of the executed and the third acquirer, until the legal requirements for the recognition of fraud to the execution involving assets that do not have in their public record an annotation of the existence of action. In view of the duties arising from objective good faith, it was studied what are the effects for the purpose of recognizing execution fraud, the fact that the third party acquirer has not obtained the certificates of distribution of shares in name of the executed in the region where he resides and in the forum of the situation of the property. At end, it can be concluded that this fact fits as vehement evidence of the bad faith of the third party acquirer, however, to demonstrate the bad faith of the third party acquirer for the purpose of fraud in the execution, it is necessary that such evidence is added to other concordant evidence, which was not ruled out by the legislative changes resulting from Law nº. 14,382/2022.ptFraude à execuçãoExecuçãoCertidõesLei nº 14.382/2022A fraude à execução e sua relação com a não obtenção prévia de certidão de distribuição de ações
