Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.http://repositorio.unialfa.com.br/handle/123456789/506The present research has the general objective of analyzing and conceptualizing in depth each of the effects of psychological violence against women, exemplified in a non-exhaustive list in the Penal Code and in the Maria da Penha Law, among other effects, valuing the legislator's progress with the attribution of the most effective punitive effect (imprisonment) to a crime that has dragged on in untouchable camouflage for centuries. In turn, the pertinence of this research is supported by the fact that, during the Covid-19 pandemic period, numerous studies were published pointing out that violence against women in the home had increased, bringing as possible causes of these aggressions, mainly husbands, partners, stepchildren and even children. Thus, it was realized that the waves of violence against women are not just a criminal problem, but also something social and historical. Likewise, it was decided to take psychological violence as a specific focus, since, in 2021, it ceased to be understood only as a form of violence and became criminalized, with the inclusion of art. 147-B in the Penal Code. The research hypothesis will seek to verify the causes and effects of psychological violence for the victim, together with the importance of public policies in overcoming these effects, and the legal conditions for its materialization as evidence in criminal proceedings. Therefore, the specific objectives are to doctrinally analyze the concept of the crime of Psychological Violence Against Women, as well as the effects of this type of aggression; and identify existing tools within the application of the new penal provision in focus. In its methodological aspect, this qualitative and descriptive research was formulated through a doctrinal investigation on the subject, especially bibliographical productions in the scope of Criminal Law with a gender perspective, in line with Constitutional Law and international conventions. In terms of bibliographical analysis, the deductive-logical method will be used, with the aim of ascertaining the doctrinal and judicial prediction regarding the effects of psychological violence against women. There was also an analysis of data provided by official publications, based on the inductive method, in order to seek concepts, theorizations and modern foundations in promoting the eradication of violence from the perspective of the female gender. Finally, it should be noted that existing tools within the scope of the Judiciary, specialized police stations and information programs that aim to feed the database and raise popular awareness on the subject will be analyzed. As a possible result, it is expected the possibility of fostering debate and a critical view about psychological violence, its effects and the importance of changes in its materialization as procedural evidence, in the performance of the Judiciary and other law enforcers, as well as in the effectiveness and execution of public policies, as access to justice for women victims of violence must be analyzed from a psychological and legal perspective, as following only one of them is leaving the other side full of ills.ptDireito constitucionalViolência contra a mulherViolência psicológicaPunibilidade
