The central problem seeks to determine whether such a prohibition constitutes a disproportionate intervention in economic activity or represents the fulfillment of a fundamental duty to protect life and animal sentience. The methodology adopts the deductive method, based on bibliographic and documentary research, as well as jurisprudential analysis. The study traces the historical evolution of the economic order, highlighting the transition from the Liberal State to the Democratic State of Law, in which free initiative must harmonize with the promotion of consumer defense and environmental protection. The theoretical framework explores the scientific recognition of animal sentience — validated by the Cambridge and New York Declarations — and the shift from the anthropocentric to the ecocentric paradigm. It analyzes the Theory of Minimal Intervention and Robert Alexy’s balancing technique to resolve the conflict between economic freedom and the prohibition of animal cruelty provided for in Art. 225, §1º, VII, of the Federal Constitution. The research details the landscape of the cosmetics industry, emphasizing that the advancement of New Approach Methodologies (NAMs), such as in vitro techniques and bioengineering, renders animal experimentation technically dispensable and economically inefficient for aesthetic purposes. The work analyzes Law No. 15,183/2025 and the State's inducing role in the modernization of the sector, aligning Brazil with the regulatory frameworks of the European Union. The results indicate that the intervention is legitimate and proportional, as it internalizes ethical externalities and meets the requirements of a global market guided by conscious consumption and ESG criteria.
