Although these instruments serve a social purpose, they are inserted into the credit market, raising legal questions regarding the applicability of the Consumer Protection Code (CDC) to credit agreements for educational purposes. The issue involves the triangular interaction between student, educational institution, and financial agent, often mediated by the State, as well as the assessment of factors such as contractual imbalance, the student’s technical and financial vulnerability, and the economic effects of the current model. The central hypothesis argues that the Consumer Protection Code applies to such contracts, given the presence of a consumer relationship characterized by informational asymmetry and the high vulnerability of the client.
