Since antiquity the aforementioned freedom practically did not exist; we will find out if in modern States, under the aegis of democracy and law, under the protection of norms and constitutional jurisdiction, this freedom that connects with belief, conscience, worship and thought, is still treated as a diminutive right, of little value. We aim to probe how constitutionalism can corroborate to prevent abuses and avoid setbacks, mainly through the exercise of constitutional jurisdiction, as it is external as guardian of fundamental rights, among these that of the Sabbath keepers. The issue of religious freedom of Sabbatarians goes back to a problem that encompasses access to work, education and public office, as these rights are indeed put in check, and even curtailed, in various circumstances when the Sabbath keepers stand firm. conscience and remain firm in the exercise of their freedom of belief, often being forced to abdicate their fundamental human right to religious freedom, in order to have access to other rights that are essential to them as well. The relevance of the theme is perceived by the connection with the dignity of the human person, which underlies religious freedom, and this is supported by tolerance, isonomy, secularism and self-determination of being.
