Tese (Doutorado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.http://repositorio.unialfa.com.br/handle/123456789/464This thesis aims to investigate the origin of women's submission in intimate relationships of affection and its impact on patrimonial domestic violence against women practiced during stable union and marriage in Brazil, evaluating the adequacy of legal instruments in facing this problem. The research is based on the following hypotheses: 1) legislation has not yet detailed the forms that domestic violence can assume because society maintains the patriarchal system in its greatest exponent: the capitalist system; 2) the affectivity of women, encouraged by the belief in the traditional family stimulated by patriarchy for centuries, is an obstacle for the identification of this factor by the Judiciary, within domestic violence, in particular, property violence. The question is: 1. Is female submission originated by a power exercised by patriarchy against women? 2. Does female submission have its origin in financial dependence? and 3. Does unpaid domestic work lead to or maintain the cycle of dependency and domestic violence against women? In order to answer the central questions of the research, the deductive methodology was used and a bibliographical review was used, having sought, as a theoretical reference, the work developed by Federici (2017) that investigates patriarchy and the development of capitalism as a problem as ways of subjugating the woman and reserving her to an economy of care exercised by unpaid domestic work, by Gerda Lerner (2019) notes on the origin of patriarchy, reflections by Simmel (1999) on female culture and the power to which women submit, which is also dealt with by Rolf Madaleno (2018, 2021) when talking about property violence, as well as other contemporary theorists of Brazilian Family Law. The study demonstrated that female submission, whether made possible by the economic power exercised by the male gender or by affectivity, reinforces gender inequality and gives rise to violence against women. In addition, affectivity was identified as an ally in maintaining the patriarchal system. The vulnerability of women stems from the patriarchal power, historically exercised by men over her, her body and her affectivity, increased and qualified by the development of capitalism. In the end, the research proposes a mechanism to face domestic violence in Brazil, in the form of patrimonial violence, in order to guarantee the effectiveness of gender equality.ptPoder e patriarcadoAfetividadeViolência doméstica patromonialLei Maria da Penha
