In this context, Regulatory Agencies assume an essential role, characterized by refined technique and speed in processes, including normative action, creating rules and regulations. This normative action may conflict with the constitutional principles of legality and, specifically, the legal reserve. The debate arises regarding the scope of this normative power between the points of greater autonomy and independence of regulatory agencies and the maintenance of the legislative power of the Legislative Branch as necessary and irreplaceable editing of formal law. This work analyzes the evolution of Economic Law, from the perspective of market regulation, in global and national terms, the emergence of regulatory agencies and incorporation into the Brazilian legal system, the constitutional principles of legality and legal reserve and doctrinal and jurisprudential positions current Brazilians on the topic. Finally, despite the conclusion that the principle of legal reserve is relativized in favor of regulatory agencies, it is certain that the topic still encourages legal debate regarding the establishment of the ideal limits of this normative action, with which this work aims to contribute.ptRegulação no Direito EconômicoPoder NormativoAgências Reguladoras
