Making a connection with the constitutional principle of free enterprise. Because it is a contract that originates in the freedom to undertake and entrepreneurship. Thus, the built to suit contract constitutes a complex instrument that involves the construction of a building to specifically meet the needs previously presented by an interested party in leasing a property, in order to develop their business there. The perspective that surrounds this enterprise is the broad freedom to undertake a business that can involve more actors because it is, as a rule, a large-scale enterprise. There is a great discussion in the doctrine regarding the fact that this is a lease agreement. However, most align the BTS contract as a lease agreement. One of the paradigms of this contract is the freedom to undertake and the impulse given to the economy and society, having as one of its foundations the constitutional principle of free enterprise. And in this sense, the constitutional principle of free initiative, in addition to the freedom to undertake, also conditions this freedom to certain social objectives. This work intends to analyze the hypothesis that the built-to-buit contract, in addition to opportunities to generate economic value, also contributes to the achievement of the social objectives listed in the constitutional principle of free enterprise, especially the objectives of the social function of property, the guarantee of full employment and social and regional development.ptLocaçãoBuilt to suitLivre iniciativa
