One of the ways the State acts is through regulatory agencies, which is why they were included in the Brazilian legal system. However, there are other possibilities for regulation, even without the necessary state presence, such as CONAR and don't disturb me. The advances of the current disruptive moment are marked by the massive use of the internet in all fields of society. Commercial activity was not oblivious to these transformations, it migrated to the electronic medium, giving rise to the digital economy. Broad, open concept still to be defined, as well as the necessary regulation. There are initiatives to build state regulation, which is already happening, for example, in the European Union and the United States; in Brazil, it is outlined by Bill 2,768/2022. The lack of regulation leads to demands for the application of existing standards to be applied to the Brazilian Judiciary. In the end, it is suggested that the self regulation model should not be applied to digital economic activity, given the small number of companies that already dominate the world market, combined with the commercial practices applied by them. Reasons why, it is argued that the regulation of the digital economy must come from the state entityptAtividade econômica digitalIntervenção do estado na EconomiaLiberdade econômicaRegulação atividade econômica digital: desafio contemporâneo
