The theme is limited to the study of social control, internal and external control, provided for in article 9 of the PNAE Law, in view of the problem of effectively guaranteeing the fundamental right to school meals. The objective is, from the contextualization of deficiencies in the execution of the National School Feeding Program, to demonstrate that the improvement of the actions of these control systems can result in the effectiveness of the public policy in question. The research was carried out through bibliographic surveys on the subject and the study of the legal diplomas that govern and guide the dealings with human and fundamental rights, the performance of control in the inspection of public policies and the specificities of the National School Feeding Program. The approach method used was the deductive one, starting from theoretical premises that can be concluded about the problem raised. Historical research was used to understand the institutes in current terms, providing elements to verify the evolution of fundamental rights and the State's action in favor of the protection of these rights.
