Within this setting, financial citizenship, institutionalized by the Central Bank of Brazil as a strategic objective under the BC+ and BC# agendas, operates as a public policy category oriented toward inclusion, education, protection, and participation; nonetheless, it displays significant ambivalences when it is primarily associated with formal access and digitalization, without a corresponding imposition of robust duties of substantive transparency and product suitability to the consumer’s profile. The overarching objective is to analyze the legal protection afforded to hypervulnerable consumers in light of technological innovations in the financial sphere that enable facilitated access to credit, and to assess the resulting impacts on financial citizenship, understood as the set of institutional and cognitive conditions that allow individuals to manage resources with autonomy and awareness, under the safeguards of transparency and good faith. The specific objectives are to examine the applicable normative framework and the potential regulatory insufficiency in protecting hypervulnerable consumers in the face of technological innovations in credit offerings; to evaluate the impact of digital contracting technologies on the facilitation of credit and their repercussions on the effective realization of financial citizenship; to investigate the effectiveness of financial education policies and protection mechanisms directed to groups in situations of aggravated vulnerability; and to discuss forms of state intervention capable of reconciling financial inclusion with the constitutional protection of consumers, aiming at mitigating over-indebtedness and rebalancing market relations. Methodologically, the research combines bibliographic and documentary inquiry, mobilizing scholarship in Constitutional Economic Law, Consumer Law, and financial regulation, as well as normative analysis. In addition, a jurisprudential study is conducted through the selection of judicial decisions, with particular attention to the case law of the Superior Court of Justice, given its role in harmonizing the interpretation of federal law. The hypothesis is that the insufficiency of protection for hypervulnerable consumers stems from a merely formal conception of financial citizenship which, by privileging inclusion and the digitalization of credit, tends to neglect the constraints imposed by the constitutional economic order, especially regarding the duty to conform market dynamics to constitutional ends and to safeguard the existential minimum. The Constitution positions consumer protection as a structuring element of economic rationality and conditions the expansion of digital credit on substantive transparency, responsible lending, and the proper allocation of supplier liability, including liability for product design and the contracting experience.
